We collect user data to provide, secure and improve our Services and to enhance your experience.
This Privacy Policy is part of our Terms and Conditions available at https://funcrush.com/terms and applies to all users of our services (each, a “User,” collectively, the “Users”), which include the FunCrush mobile application available on the Apple App Store and Google Play (the “App”), our website at https://funcrush.com (the “Website”), and our related products, content and features (collectively, the “Services”). It applies to people who create accounts (“Accounts”) with us, who play games or take part in activities available through the Services.
Important notice about FunCrush: FunCrush is intended for entertainment purposes only. The Services do not offer real money gambling or any opportunity to win real money or real prizes. Virtual coins, credits and other virtual items used in FunCrush have no monetary value and cannot be exchanged, cashed out or redeemed for money, goods or anything of value. Practice or success at social casino gaming does not imply future success at real money gambling.
Please read this Privacy Policy carefully. It explains what information we collect, why we collect it, how we use and share it, how long we keep it, and the rights and choices available to you. If you do not agree with this Privacy Policy, please do not use the Services or submit any Personal Information to us. Where we rely on your consent, we will ask for it separately, and you can withdraw it at any time.
This Privacy Policy contains the following information, which you can access by scrolling down:
The App and the Website are operated by Meritum Soft d.o.o., a company registered in the Republic of Croatia with its registered office at Optujska 45, 42000 Varaždin, Croatia. Meritum Soft d.o.o. is the data controller responsible for the processing of your Personal Information described in this Privacy Policy.
You can contact us about any privacy matter by email at [email protected], by telephone at +1 407 6345254, or by post at the address above. Further contact details are set out in Section 20 (How to Contact Us).
“Personal Information” is any information that could, alone or together with other information, identify you or be reasonably linked or connected with you, your device or your household. Examples include a username, an email address, a device identifier, an Internet protocol (IP) address and a profile picture. We collect Personal Information in three ways: information you provide to us directly, information collected automatically when you use the Services, and information we receive from third parties.
Information you provide to us. We may collect Personal Information when you:
Information collected automatically. When you use the Services, we and our service providers may automatically collect:
Information from third parties. We may also receive information about you from:
Information we do not collect. We do not request access to your contacts, photos, camera, microphone, health data or precise location. We do not knowingly collect special categories of personal data (such as information about health, racial or ethnic origin, religious beliefs, sexual orientation or biometric data), and we do not collect payment card or bank account details.
When you use the Services, we may collect information that is automatically sent to us by your device or web browser, as described in Section 2. The amount of information sent to us by technological means depends on your device, browser and the settings you use. Please refer to the instructions provided by your device or browser if you want to learn more about what information it sends and how to change or restrict this.
We and our third-party partners use software development kits (“SDKs”) in the App and cookies, web beacons, tracking pixels, local storage and similar technologies on the Website (collectively, “Tracking Technologies”). We use Tracking Technologies:
Where required by applicable law (including the EU ePrivacy rules), we will ask for your consent before using non-essential Tracking Technologies. Most web browsers also allow you to control, disable or delete cookies. If you disable certain Tracking Technologies, some features of the Services may not function properly. You can find more information about managing cookies at https://allaboutcookies.org.
We use the information we collect for the purposes listed below. For Users in the European Economic Area (“EEA”), the United Kingdom and other jurisdictions that require it, we also identify the legal basis on which we rely:
Where we rely on legitimate interests, we have balanced those interests against your rights and freedoms, and you have the right to object as described in Section 12. We use automated systems to detect fraud, cheating and abuse, but we do not make decisions based solely on automated processing that produce legal or similarly significant effects for you.
We may combine, analyze, process and store the information we collect for the purposes described above, and we may create aggregated or de-identified information that does not identify you, which we may use and share for any lawful purpose.
We do not sell your Personal Information for money. We share Personal Information only as described in this Privacy Policy:
Any third party with which we share user data is required by contract to provide the same or an equal level of protection for that data as described in this Privacy Policy and as required by applicable law. A list of the principal third-party service providers and SDKs we use is available on request by contacting us at [email protected].
The App may display advertisements, including optional rewarded advertisements that grant virtual items in exchange for watching an ad. Advertising and attribution partners may collect information through their SDKs, including device identifiers, IP address and information about your interaction with ads.
iOS users. We will only access your device’s advertising identifier (IDFA) or track you across apps and websites owned by other companies if you give us permission through Apple’s App Tracking Transparency prompt. You can change this permission at any time in your device under Settings > Privacy & Security > Tracking. If you do not give permission, you may still see ads, but they will be less relevant to you.
Android users. You can reset or delete your Android advertising ID, or opt out of personalized advertising, in your device settings (typically under Settings > Privacy > Ads, or Settings > Google > Ads, depending on your device).
Users in the EEA, the United Kingdom and Switzerland. We ask for your consent through a consent management tool before personalized advertising is shown or non-essential Tracking Technologies are used. If you do not consent, you may see non-personalized ads.
Users in the United States. Certain U.S. state laws treat some advertising-related disclosures as a “sale” or “sharing” of Personal Information or as “targeted advertising.” You can opt out of such processing through your device settings described above, or by contacting us at [email protected].
Virtual items have no monetary value outside the Services and cannot be exchanged for real money or prizes.
The security of your Personal Information is important to us. We use appropriate technical and organizational measures designed to protect Personal Information against unauthorized access, loss, misuse or alteration, including encryption of data in transit using Transport Layer Security (TLS), encryption of stored data where appropriate, storage in password-secured databases within a virtual private cloud (VPC), access controls that limit access to persons who need it to perform their duties, and regular review of our security practices.
No method of transmission over the internet or method of electronic storage is 100 percent secure, so we cannot guarantee absolute security. In the event of a personal data breach, we will act promptly to mitigate its impact and will notify the competent supervisory authority and affected Users where and as required by applicable law, including, where required, within seventy-two (72) hours of becoming aware of the breach.
We store Personal Information in secure databases, with Personal Information tied to specific user records. Personal Information may be stored and processed in the European Union and, through our service providers, in other countries, including the United States.
When we transfer Personal Information from the EEA or the United Kingdom to a country that has not been recognized as providing an adequate level of data protection, we rely on appropriate safeguards, such as the Standard Contractual Clauses approved by the European Commission (and the UK addendum where applicable), or on the recipient’s certification under the EU-U.S. Data Privacy Framework where applicable. You may request more information about these safeguards by contacting us.
We keep Personal Information only for as long as necessary to provide the Services and fulfil the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. In general:
The Services may contain links to, or integrations with, applications, technologies or websites owned and operated by other parties, such as Apple, Google, social media platforms and advertisers. This Privacy Policy does not apply to those third-party services. You should review the relevant third party’s terms of use, privacy policy, permissions, notices and choices regarding their collection, storage and sharing practices, since they may be different from ours.
Do Not Track is a privacy option that people can set in certain web browsers to tell websites they do not want certain information about their visits collected over time and across websites. Because there is no common industry standard for responding to Do Not Track signals, we do not currently respond to them. However, where required by applicable law, we treat a Global Privacy Control (GPC) signal sent by your browser as a valid request to opt out of the sale or sharing of your Personal Information and targeted advertising for that browser.
Depending on where you live, you have some or all of the following rights in relation to your Personal Information:
You can exercise these rights through the settings in the App, by contacting us at [email protected], or by telephone at +1 407 6345254. You may also designate an authorized agent to make a request on your behalf where permitted by law; we may ask the agent for proof of authorization and may ask you to verify your identity directly.
Right to lodge a complaint. If you believe that our processing of your Personal Information infringes applicable data protection law, you have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, place of work or place of the alleged infringement. Our lead supervisory authority is the Croatian Personal Data Protection Agency (Agencija za zaštitu osobnih podataka - AZOP), Selska cesta 136, 10000 Zagreb, Croatia, https://azop.hr. We would, however, appreciate the chance to address your concerns first, so please contact us beforehand.
Registered Users can view and update certain personal information, Account settings and notification preferences directly in the App, depending on their sign-in method and the available functionality.
You may also request access to, or correction of, your Personal Information by contacting us at [email protected], by telephone at +1 407 6345254, or through the support option in the App. Once we receive and verify your request, we will provide you with, as applicable:
You can delete your Account and associated Personal Information at any time using any of the following methods:
Once we receive and verify your request, your Account will be closed and we will delete (and direct our service providers to delete) your Personal Information within thirty (30) days, unless an exception described below applies. Residual copies in secure backups are deleted in the ordinary course, generally within ninety (90) days. If you signed in with Apple, we will also revoke the associated Sign in with Apple tokens.
Please note that deleting your Account is permanent. You will lose access to your Account, game progress, and any virtual coins and virtual items, which cannot be restored. Uninstalling the App does not delete your Account.
We may retain certain information after Account deletion where it is necessary to:
Any retained information will be limited to what is necessary for these purposes, protected as described in this Privacy Policy, and deleted when it is no longer needed.
You can manage your communication and privacy preferences as follows:
We will process opt-out requests promptly, and in any event within the time required by applicable law. Even if you opt out of marketing communications, we may still send you non-promotional messages, such as messages about your Account or changes to our policies.
If we process your Personal Information and you do not have an Account (for example, if you visit the Website or use the App without registering), you may, subject to applicable law, access, correct, delete or object to the processing of your Personal Information by contacting us at [email protected] or by telephone at +1 407 6345254. Guest Play uses a temporary demo balance, and gameplay progress is not retained after you exit Guest Play. We may still process technical and usage data as described in this Privacy Policy.
We will respond to requests to exercise your rights without undue delay and in any event within one (1) month of receipt. Where necessary, taking into account the complexity and number of requests, we may extend this period by up to two (2) further months, in which case we will inform you of the extension and the reasons for it within the first month. Where U.S. state laws apply, we will respond within forty-five (45) days, which may be extended by a further forty-five (45) days where reasonably necessary.
To protect your information, we may need to verify your identity before responding, for example by asking you to make the request from the email address associated with your Account or to provide your player ID. If you have an Account with us, we may deliver our written response to that Account; otherwise, we will respond electronically. If we cannot comply with a request, we will explain why. For data portability requests, we will provide your Personal Information in a structured, commonly used and machine-readable format.
We do not charge a fee to process or respond to your request unless it is manifestly unfounded or excessive, in particular because of its repetitive character. If we determine that a request warrants a fee, we will tell you why and provide a cost estimate before completing your request.
The Services are intended only for adults. You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to use the Services. The Services are not directed at children, and FunCrush does not participate in Apple’s Kids Category or the Google Play Families program. By using the Services, you confirm that you meet these age requirements.
We do not knowingly collect or maintain Personal Information from anyone under eighteen (18) years old. If we learn that we have collected Personal Information from a person under eighteen (18), we will close the Account and delete that information as quickly as possible.
If you are a parent or legal guardian and believe that a person under eighteen (18) has provided us with Personal Information, please contact us at [email protected].
We may update this Privacy Policy from time to time to reflect changes in our practices, the Services or applicable law. The “Last Updated” date at the top of this Privacy Policy shows when it was last revised, and the current version is always available at https://funcrush.com/privacy and in the App.
If we make material changes, we will notify you at least thirty (30) days before the changes take effect by a notice in the App or on the Website, or by email to the address associated with your Account. Where the changes require your consent under applicable law, we will ask for it. Changes that are not material, or that are required by law, may take effect immediately upon posting.
If you have any questions about this Privacy Policy, wish to exercise any of your rights, or have any concerns about how we handle your Personal Information, please contact us. We will respond promptly and in any event within the time limits set out in Section 17.
